1. Acceptance of Terms

By accessing or using apnaastroai.com and its services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms constitute a legally binding agreement between you and ApnaAstroAI.

2. Description of Service

ApnaAstroAI provides AI-powered Vedic astrology services including:

  • Kundali generation (Janam Kundali, Navamsha, Dashamsha, Prashn Kundali)
  • Kundali Milan (compatibility matching)
  • Palmistry / Hast Rekha analysis from uploaded palm photographs
  • Numerology, baby name recommendations, gemstone calculator
  • Daily Horoscope / Rashifal and transit alerts
  • AI Pandit Ji chat and voice consultation
  • Brihat Kundali (detailed 250+ page AI-written report)
  • Soulmate Sketch (AI-generated partner portrait and compatibility)
  • Live Pandit Ji bookings (human astrologer consultations)
  • Pooja booking services

3. Eligibility

  • You must be at least 18 years of age to register and use ApnaAstroAI.
  • By using the Service, you confirm you meet this requirement.
  • Services involving a minor's birth data (e.g., baby name suggestions, child Kundali) may be requested by a parent or guardian on the child's behalf.
  • You must not be prohibited from receiving our services under any applicable law.

4. Account Registration and Security

4.1 Registration Methods

  • Mobile OTP: Enter your mobile number and verify via OTP sent via WhatsApp/SMS.
  • Google Sign-In: You may sign in using your Google account via OAuth 2.0. By doing so, you authorise us to receive your name, email, and Google account ID from Google.

4.2 Your Responsibilities

  • You are responsible for all activity that occurs under your account.
  • You must provide accurate, current, and complete registration information.
  • You must notify us immediately at [email protected] if you suspect unauthorised access to your account.
  • You must not share your account credentials with any third party.

5. Plans, Pricing, and Payment

5.1 Plan Types

  • Question-Based Plans: You receive a fixed number of questions to ask our AI Pandit Ji within a validity period (typically 30 days).
  • Time-Based Plans: You receive a fixed number of minutes for AI chat or voice consultation within a validity period.
  • Free Plan: Limited questions/features available to all registered users at no charge.
  • Question Boosters: Additional questions can be purchased at ₹5 per question (minimum 2 questions) outside of a plan.
  • One-Time Purchases: Brihat Kundali reports and Soulmate Sketch are purchased as one-time items.

5.2 Pricing

All prices are displayed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise. Prices are subject to change; changes apply to future transactions only and will not affect active subscriptions mid-term.

5.3 Payment Processing

Payments are processed by Razorpay, PhonePe, or Paytm depending on your selection. By completing a payment, you agree to the terms of the respective payment gateway. We do not store your card number, CVV, UPI PIN, or banking credentials.

5.4 Unused Credits

Unused questions or call minutes do not carry over after a plan expires unless you renew or upgrade your plan before the expiry date, in which case remaining credits are added to the new plan.

6. Refund and Cancellation Policy

Please refer to our standalone Refund & Cancellation Policy for complete details. Key points:

  • Refunds are available if a reading was not delivered due to a verified technical error on our part.
  • No refunds for completed AI readings (delivered instantly and digitally).
  • Plan expiry does not entitle you to a refund for unused credits.
  • Raise refund requests within 7 days at [email protected].

7. Palm Photograph Upload

  • By uploading a palm photograph, you consent to our AI processing that image solely to generate a palmistry reading.
  • Palm photographs are not shared with any third party except the AI model provider used for analysis.
  • Palm photographs are automatically deleted within 30 days of upload.
  • Do not upload photographs of other people's palms without their explicit consent.

8. Voice Chat and Audio

  • Voice Chat mode uses text-to-speech technology via ElevenLabs. Your text queries are converted to audio in real time.
  • No voice recordings are permanently stored by ApnaAstroAI.
  • By using Voice Chat, you consent to your queries being processed by ElevenLabs' API.

9. Live Pandit Ji Bookings

  • ApnaAstroAI provides a platform to book live consultations with independent Pandit Ji / astrologers listed on our directory.
  • Pandit Ji are independent practitioners, not employees of ApnaAstroAI.
  • ApnaAstroAI is not responsible for the content or accuracy of advice given by a Pandit Ji during a live consultation.
  • Booking cancellations must be made at least 2 hours before the scheduled slot for a refund. Late cancellations are non-refundable.
  • If a Pandit Ji cancels or does not show, you will receive a full refund or a complimentary rescheduling.

10. Brihat Kundali and Soulmate Sketch

  • Brihat Kundali is a one-time purchase generating a 250+ page personalised AI-written astrological report.
  • Soulmate Sketch generates an AI portrait and compatibility analysis based on your astrological data.
  • Both are delivered digitally and are non-refundable once generated, except in case of technical failure.

11. WhatsApp Communications

  • By registering with your mobile number, you consent to receiving OTP messages via WhatsApp or SMS for authentication.
  • Transactional WhatsApp notifications (booking confirmations, plan expiry, reading delivery) will be sent where relevant.
  • You may opt out of non-essential WhatsApp communications by contacting [email protected].

12. Referral Programme

For complete terms, see our Referral Programme Terms. Key points:

  • Each registered user receives a unique referral code.
  • When a new user registers using your referral code, both parties may receive benefits as specified on the referral page.
  • Referral benefits are non-transferable and have no cash value.
  • Fraudulent referral activity (fake accounts, self-referrals) will result in account suspension.

13. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to reverse-engineer, scrape, copy, or reproduce our AI models, prompts, or content at scale.
  • Submit false or misleading birth information to manipulate readings.
  • Create multiple accounts to exploit free plan credits or referral rewards.
  • Impersonate any person or entity, or falsely claim affiliation with ApnaAstroAI.
  • Resell, redistribute, or commercially exploit readings or reports without written permission.
  • Use automated bots, scrapers, or scripts to access or extract data from the Service.
  • Upload harmful, offensive, or illegal content including photographs.
  • Interfere with or disrupt the Service's infrastructure, security, or performance.

14. Intellectual Property

All content, software, AI models, brand names, logos, and designs on ApnaAstroAI are the intellectual property of ApnaAstroAI and are protected under Indian and international copyright, trademark, and IP laws.

Your personal readings and reports are licensed to you for personal, non-commercial use only. You may share them privately but may not publish or sell them commercially.

15. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind — express or implied — including but not limited to accuracy of readings, fitness for a particular purpose, or uninterrupted availability. Astrological readings are generated by AI and do not constitute professional advice of any kind.

16. Limitation of Liability

To the maximum extent permitted by Indian law, ApnaAstroAI, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total cumulative liability for any claim shall not exceed the amount you paid to us in the 3 months preceding the claim.

17. Indemnification

You agree to indemnify and hold harmless ApnaAstroAI and its affiliates, officers, and employees from any claims, damages, losses, or legal costs arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.

18. Account Suspension and Termination

We reserve the right to suspend or permanently terminate your account without prior notice if you violate these Terms, engage in fraudulent activity, or abuse the platform. You may delete your account at any time from your profile settings.

19. Modifications to Service and Terms

We may modify these Terms, the Service, or pricing at any time. Material changes will be notified via email or website notice at least 15 days before taking effect. Continued use after the effective date constitutes acceptance.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute shall first be attempted to be resolved in good faith within 30 days of written notice. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts at Gurugram, Haryana, India.
